1. User Content and Permissions

By submitting photos or other materials ("User Content"), you grant Tio Magic a limited, non-exclusive license to use, modify, stylize, and animate your User Content solely for the purpose of producing and delivering your personalized product or service. This license is restricted to fulfilling the Services and does not authorize any other use of your User Content.

You represent and warrant that you own, or otherwise have all rights necessary to provide, the User Content, and that its submission and use in accordance with these Terms will not infringe, misappropriate, or otherwise violate any third-party rights.

2. No Model Training

Tio Magic does not train, fine-tune, or otherwise adapt AI models on User Content. Furthermore, Tio Magic does not rely on third-party APIs or services that train or fine-tune models on User Content.

3. Restrictions on Use

You may use your personalized product or service for private, personal enjoyment only. You are expressly prohibited from selling, sublicensing, redistributing, or otherwise commercially exploiting the animations or any portion thereof. Additionally, you may not use the Services for any unlawful, harmful, or offensive purposes.

4. Data Retention and Deletion

User Content is deleted once your product or service has been produced and delivered. Tio Magic may retain non-identifiable system data (such as logs or error reports) for operational, analytical, and security purposes.

5. Access to Content

The products or services we produce are made available for your personal enjoyment under these Terms. You are granted the right to view and privately use the content; however, you do not obtain any rights to sell, license, redistribute, or commercially exploit the animations or the media used to produce them.

6. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Tio Magic disclaims all warranties, whether express, implied, or statutory, including without limitation any warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, Tio Magic shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or related to your use of the Services, even if advised of the possibility of such damages.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California and the United States.

9. Modifications

Tio Magic may update or revise these Terms from time to time. Any changes will be effective upon posting with a revised "Effective Date." Continued use of the Services after such changes constitutes acceptance of the updated Terms.

10. SMS Communications

By opting into our SMS program, you agree to receive recurring automated text messages (including reminders and coordination messages) related to your scheduled user interviews with Tio Magic Company. Consent to receive SMS messages is not a condition of any purchase or participation in other services.

Message frequency varies based on your interview schedule. Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Mobile carriers are not liable for delayed or undelivered messages.

You can cancel the SMS service at any time by texting STOP to the number from which you received messages. After we receive your STOP message, we will send a confirmation SMS and you will no longer receive SMS messages from us. If you wish to re-enroll, simply opt in again as you did the first time.
